These terms govern your use of switchpointbackup.com (the "site") and, where you become a customer, the SwitchPoint managed internet failover service (the "service"), both provided by SwitchPoint Backup LLC ("SwitchPoint," "we," "us"). By using the site or service you agree to these terms.
What the service is
SwitchPoint deploys and manages a business internet failover system that switches to a cellular connection when your primary internet connection drops. We are not an internet carrier, ISP, or utility, and we do not manufacture hardware. Your primary internet service remains with your existing provider.
Service performance
- The service is designed for business continuity during outages. It keeps critical operations such as point of sale, VoIP, email, and cloud apps running. It is not a full-speed replacement for a wired connection.
- Cellular failover performance depends on local coverage, signal strength, carrier conditions, and the deployment environment, and may vary.
- Each plan includes a defined monthly data allowance for failover. When the allowance is reached, the backup connection stops. We do not add overage charges automatically. Additional capacity is added only with your approval.
Billing and cancellation
Pricing, billing period, and any deployment terms are set out in your order or quote. Fees are billed in advance for each period. You may cancel as described in your order; cancellation stops future billing and ends managed monitoring and support.
Acceptable use
You agree not to misuse the site or service, interfere with its operation, attempt unauthorized access, or use it for unlawful activity.
Intellectual property
SwitchPoint, SwitchPoint Backup, the SwitchPoint orb logo, and the content of this site are the property of SwitchPoint Backup LLC. Third-party names and trademarks are the property of their respective owners and are used for identification and compatibility only.
Disclaimers and limitation of liability
The site and service are provided on a commercially reasonable basis. To the fullest extent permitted by law, SwitchPoint is not liable for indirect, incidental, or consequential damages, or for losses arising from an internet, carrier, power, or hardware failure outside our reasonable control. Our total liability for any claim is limited to the amount you paid for the service in the three months before the claim.
Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules.
Changes
We may update these terms and will change the effective date above when we do. Continued use after a change means you accept the updated terms.
